General

Any order accepted by Living It Up is subject to the terms and conditions specified in this contract unless otherwise stipulated in writing by Living It Up. Please read these terms carefully. The terms and conditions specified herein do not affect your statutory rights.

These terms may be subject to change (e.g. delivery times/terms/guarantees) if this is the case any changes will apply to new orders but not to existing orders

Description of Goods

It is the responsibility of the customer to check that their order is confirmed correctly.

Dimensions of all products are available on the Living It Up website and the customer should satisfy themselves that the goods will fit into their property as intended.

Products pictured on the website may be photographed with other items which are not included in the product description. Photographs are for illustrative purposes only.

Upholstered Furniture

Our upholstered range is made to order, fabric is received in batches - this means there may be a slight variation in the colour of each batch, although we work hard to ensure they are as consistent as possible we cannot guarantee every batch of a fabric will be identical.

As each item is handmade, measurements provided are not exact and can vary by a few centimetres.

We do not accept responsibility for any fading or discoloration that may occur due to exposure to direct or indirect sunlight.

We also do not accept responsibility for fading or discoloration that may occur due to exposure from chemicals which are sprayed on or near your furniture.

We recommend that your furniture is always cleaned by professional upholstery cleaners.

Payment and Pricing

Living It Up accepts payment from credit and debit cards registered in the UK only. We also accept payment by other methods, such as bank transfers, cash and cheque.  All product prices include VAT at the prevailing rate.

We cannot change the delivery address for orders paid with PayPal, we can only deliver to the address on the order confirmation.

Living It Up reserves the right to refuse any order which is subject to errors in pricing or where it is no longer possible to supply a particular product for some reason.

Payment for an order is processed immediately when the order is received by Living It Up unless there are any unresolved issues with stock availability.

In the event that Living It Up cannot meet the order requirements then the customer will be informed within 48 hours of the order being received (Slightly longer if the order is taken over the weekend or a bank holiday) Once payment is processed then a contract exists between Living It Up and the customer and that contract is governed by these terms and conditions.

In the event of any price increases once an order has been confirmed (this could be reasons such as increased materials cost, increased shipping costs, or changes in exchange rates) we will get in touch with you to confirm the new price.  The buyer has the right to cancel their order for a full refund.

Delivery

When your order arrives into stock we aim to deliver within 7-10 working days, some postcode areas may take a little longer. Estimated leadtimes are stated on each product page and are subject to change. Delivery will be carried out by a contracted third party courier or by Living It Ups' own delivery operatives.

Our standard delivery charges to UK mainland addresses are shown on each product page. Delivery to the following postcodes EX, TQ, PL, TR, TA, CF, NP, LD, SA, LL, SY and surrounding Welsh borders will incur a surcharge starting at £150. We currently cannot deliver to some areas of the North West (LA, CA), North East (Some NE codes), Scotland and Scottish Borders. However if an order is placed and it is showing 'Shipping Not Available' please contact us for a quote. If an order is placed and surcharge applies that is not visible on the order, we will get in touch with you to let you know before processing the order. 

Please remember that it is the customers responsibility to check that all items will fit through doors and staircases in their packaging.  If an order is returned on the day of delivery due to issues with access, then the order is subject to a £150 restocking charge. Access checks can be arranged before you order if you are unsure if an item will fit into your property.

Delivery is normally arranged by telephone or email to ensure a delivery date is agreed with the customer. Where this is the case, Living It Up reserves the right to charge a minimum of £100 for delivery if the agreed delivery fails because the customer is not present to accept delivery.  

Our two man delivery team can not undertake any specialist deliveries, which could include lifting furniture over bannisters and balconies, or any deliveries where heavy lifting equipment would be required.  Our delivery partners can provide a specialist delivery for awkward property access or if more than two people are required - quotations can be provided at the time if required.

For items that are being delivered above the third floor and there is no access to a suitable lift there is a charge of £30 per floor per item.  It is your responsibility to inform the delivery team that access is above the third floor when delivery is being arranged - if they are not informed you will be given the option to have the goods delivered to the entrance of your building or returned to the warehouse.  A restocking fee will apply.

On the day of delivery it is the customers responsibility to ensure floors are covered and any light fixtures, photographs, ornaments etc are removed before the delivery team arrives.  If when the delivery team arrives on site and feel that access may be tight for the product that is being delivered, they will discuss this with you at the time and ask you to sign a waiver if you still request for delivery to be attempted.

Any damages must be reported to the delivery team whilst they are still on site and noted on the delivery paperwork.  Any claims after they have left your property will not be considered.

Living It Up does not undertake delivery outside of Mainland UK but may accept orders if the customer is willing to arrange their own transportation. It is the customers responsibility to ensure that your order is checked before items are shipped.

Risk for the goods passes to the customer upon delivery. Regardless of delivery status ownership of the goods will pass when payment has been received.

The customer should check their delivery thoroughly on receiving the goods. If the delivery is checked and any damage is found this should be clearly noted on the proof of delivery. If the customer is unable to check the goods then they should be signed for as unchecked.

Living It Up does not accept responsibility for any consequential loss as a result of unsuccessful delivery.

Storage

Unfortunately we are unable to store items for you, if a delivery cannot be accepted once it’s arrived into stock your order will be subject to storage charges of £75 per week per item after 10 calendar days of receipt into the warehouse.  Our delivery partners will advise you at the time and take payment directly if required.  If storage charges are not paid the order will be cancelled and refunded minus any charges already incurred.  We will confirm in writing before the charges are deducted.

Promotional Codes & Offers

Only one promotional code may be used per order. Promotions do not apply to delivery cost unless specifically mentioned.

Living It Up reserves the right to refuse or cancel promotional codes at any time. Special offers on free delivery do not apply to orders for delivery outside the UK Mainland and the following postcodes: AB, LD, PH7+, SA30+, TR, IV, KW, EX,TQ,PL,TR, AB, LD, PH7+, SA30+, TR, IV, KW.

Upon purchasing a product, the email you used to checkout will be entered into our mailing list but will NOT be supplied to any third parties.

Fraudulent Orders

Living It Up will take all steps which are necessary and practicable to ensure that any orders received which appear to be fraudulent are fully investigated before any goods are despatched or any payment is taken. This is for the protection of our customers.

Where the delivery address differs from the registered card address we will send out a confirmation letter to establish that the order is genuine. This procedure applies to all orders, and we are not able to dispatch any orders until we’ve received confirmation that you’ve received your letter.

Guarantees, Cancellations & Right To Return

Any defects or damages to goods should be reported to Living It Up in writing as soon as reasonably practicable after receiving the goods. Letters address to: Unit 3, 5 Knights Close, Thurmaston, LE4 8EW; or email info@livingitup.co.uk

In addition to your statutory rights, Living It Up goods are guaranteed against defects in materials or faulty workmanship for 24 months from the time they are delivered. The beechwood frames for beds, sofas and sofabeds have a 10 year guarantee.  This does not include products from our clearance or ex display range.  In the event that any goods are found to be defective within the guarantee period, or if goods are damaged in transit, then Living It Up will cover any costs incurred as a result of the need to exchange goods including transportation costs.  We do not arrange for replacement parts to be assembled for the customer and will not cover the cost if the customer wishes to source their own tradesperson to do so.

If you wish to make a claim then please contact us at info@livingitup.co.uk with images and a description of the issues for us to review.  If a repair is not possible a replacement will be offered, if a suitable replacement is not available then a refund will be offered.  After 12 months use, we reserve the right to deduct a reasonable amount with the amount of use you have had from the product.

Your rights to return goods are protected under the EU Distance Selling Directive which can be found at EU Distance Selling Directive.

The customer has the right to return goods to Living It Up provided notification of your intention to return the goods is provided in writing within 30 days of delivery.

Should the customer wish to return the goods within the 30 day cooling-off period then it is the customers' responsibility to return the item to the Living It Up warehouse in a resalable condition and at their own cost. Any items found to be dirty or soiled will need to be professionally cleaned and these costs will be deducted from the final refund.

Living It Up recognises that, for many customers, it will not be possible to arrange transport themselves and in these cases our staff can arrange collection during our business hours, if requested. Where Living It Up is required to arrange the collection, then a collection charge will be levied.

Customer cancellation rights under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulation 2013:

  • Your Right To Cancel

Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods. If your order consists of multiple goods, the 14 day period runs from when you get the last of the batch.

  • Your Right To Refund

You will receive a refund on your order within 14 days of Living It Up receiving your goods. We are within our rights to deduct from a customer refund if the value of the goods has been reduced as a result of the goods being handled more excessive than necessary. You will be refunded the amount of your item(s).

Credit Card Security

When your order is placed at our website you will be redirected to a secure hosting (EPDQ) server for payment. Here, your credit card numbers will be encrypted using 128 bit encryption. They are not held in clear text on any web site at any time.

Privacy Policy & GDPR

At Living It Up, we value our customers and understand the vulnerabilities of customer data. We are a furniture company and not in the business of selling personal information and the like to external companies. Living It Up will explicitly only use your data to deliver targeted newsletters, offers and promotions. If you would like to change how we’re able to contact you or remove you from our mailing list altogether please email info@livingitup.co.uk.

In this Privacy Policy we will provide all the information you need on when we collect your personal data, why we collect it, how we use it and also how we keep all of your sensitive data secure.

Social Media

By using #yeslivingitupuk you agree to the following Image Use Terms & Conditions under which Living It Up LTD may use 'Your Content' publicly posted by you on your social media platforms.

By consenting to our use of 'Your Content' you agree to the following:

  • We can use your social media handle and the relevant content , on all our social media platforms (Instagram / Facebook / Tik Tok) website and any other marketing material.
  • That you are 18 years of age or over.
  • We can edit, crop, enhance or modify 'Your Content'
  • You have the permission of everyone in the 'Content' to be shared.
  • You understand that there is no obligation from Living It Up LTD to pay for any use of 'Your Content'

If you (or anyone in the 'Content') asks for us to remove the 'Content', we will remove it from all social media / website / marketing materials that we control.

In addition to these Terms & Conditions, you agree to be bound by Living It Up LTD's standard Terms of Use and Privacy Policy for its websites. These may be updated from time to time.

When someone visits www.livingitup.co.uk we use a third party service, Google Analytics, to collect standard internet log information and details of visitor behaviour patterns. We do this to find out things such as the number of visitors to the various parts of the site. This information is only processed in a way which does not identify anyone. Mailing Lists

As part of the subscription process for our newsletter, we ask you to include your first name and email address – These are the only personal details we collect during sign up. You are giving consent for Living It Up to collect your data (First Name, E-Mail Address) to provide you with occasional targeted newsletters and other advertising material directly to your email address.

We use a third-party provider, MailChimp, to deliver our newsletter. We gather statistics around email opening and clicks using industry standard technologies to help us monitor and improve our e-newsletter.
